Former lawyer champions mediation as an accessible alternative to court battles

Disputes in business and personal matters can be costly, especially if they go to court to resolve but a former lawyer is offering a new service to keep costs down and get results.

Alsager-based Steve O'Gorman has set up a business called 'Fast Resolve Mediation' - designed to resolve legal disputes cheaply and quickly, working on civil, commercial and employment disputes.

But what is mediation and how does it work?

"Mediation is a simple way of settling a dispute, often legal disputes - using a trained professional to help negotiate a settlement," said Steve, who lives on the Lawton Green estate.

"Your problem could be solved cheaply and quickly. Court should be the last resort, and you could resolve your issues on the day – not the next year or two."

What can we mediate

Almost any dispute involving:

·      Money, debts, contracts, small claims, civil or commercial

·      Employment (employer, employee)

·      Neighbour, boundary, property, landlord, tenant disputes

·      Personal injury claims/negligence

·      Partnership/company disputes

·      Sports and media issues including libel

·      Disputes over wills or probate and general family disputes

How does it work?

Mediation aims to help create a conversation between the participants in which they can air any differences and work towards finding an outcome that will resolve whatever they disagree about. Often this means that the result is not one that either person or people are entirely happy with, but a resolution that they can 'live with'. It works - more than 85% of mediations end in a settlement.

Steve added: "For too long, in the Legal and Commercial work I've done over the last 30 years, I've seen people waste tens of thousands of pounds, or more, and years of effort, fighting over something that could have been resolved in a day if those in dispute would sit down and talk.

"Our legal system is not in my opinion fit for purpose; it's inaccessible to all but the rich, and a mystery to most. Mediation is far more effective at resolving disputes where, as in most cases, the legal issues are not clear cut."

"I know what it must be like to receive a letter saying you have to attend court and not knowing which way to turn," Steve said.

"Mediation is a simple and effective way to resolve a dispute using a trained and certified professional and has a success rate of over 85 per cent."
